: This paper considers whether a physician is criminally liable for administering a dose of painkillers that hastens a patient's death. The common wisdom is that a version of the doctrine of double effect legally protects the physician. That is, a physician is supposedly acting lawfully so long as the physician's primary purpose is to relieve suffering. This paper suggests that the criminal liability issue is more complex than that. Physician culpability can be based on recklessness, and recklessness hinges on (...) whether a physician has taken an unjustifiable risk of hastening death. The authors identify three conditions of justifiability. Their analysis helps to explain the distinction between euthanasia, which is legally banned, and the use of risky analgesics, which is permitted in limited circumstances. (shrink)

It has generally been observed that cells grow to a certain size before they divide. In the last few years, the PI3K signal transduction pathway has emerged as one of the main signaling routes utilized by cells to control their increase in size. Here we focus on two components of this pathway, PKB and S6K, and briefly review the experiments that initially uncovered their roles in cell size control. In addition, we discuss a number of recent observations suggesting that the (...) generic models used to describe this pathway to date may have been oversimplified. Indeed, recent observations in Drosophila and mouse support a more complex interaction between these signaling components in development. Finally, we have utilized two contemporary studies involving PKB‐ and S6K‐deficient mice as a paradigm to underscore the importance of cell size and to accurately delineate the connections between signaling pathways for human disease, such as diabetes mellitus. Are the actions of a person operating out of the gifts of the Holy Spirit the same as the actions of that person operating out of infused virtue? Answering this question provides an opportunity to offer a Thomistic account of how the gifts of the Holy Spirit are distinct from, yet related to, the infused virtues. This article begins with two recent arguments for how the gifts differ from the infused virtues. It then rejects those arguments based on Aquinas's mature (...) writing on the gifts. The following section offers an account of the role of the gifts in the graced life of discipleship, including their relationship to the infused virtues, through a focus on the relationship between habit and act. The article concludes with three areas for further research and a nod toward pastoral application of this argument in sacramental preparation for confirmation. (shrink)

The 2013 Rostock Symposium on Systems Biology and Bioinformatics in Aging Research was again dedicated to dissecting the aging process using in silico means. A particular focus was on ontologies, as these are a key technology to systematically integrate heterogeneous information about the aging process. Related topics were databases and data integration. AN INDEX OF HUME'S REFERENCES IN A TREATISE OF HUMAN NATURE The index below of Hume's references in the Treatise te the works of other authors excludes those which are accurate and full in his text (of which there are few) and those which are so general, e.g., to Spinoza's atheism, that no passage is specifiable. Hume mentions other writings, for which this index is compiled, in several (...) different ways. Occasionally he mentions the author's name, the title of his book and gives a reference which is less specific than it could be. These have been identified. Often he mentions an author's name only, e.g., de Retz, and in such cases the fullest possible reference has been given. One of Hume's notable intellectual gifts was his ability to distil several pages of a book into one or two sentences of crisp and accurate synthesis. (This skill is most apparent in his summaries of articles in Bayle' s Dictionary in his "Notes on Philosophy", of which the manuscript is in the Royal Society of Edinburgh Library.) In these instances, page references are impossible and the closest indication one can give is a section or chapter. Some of his references are anonymous, e.g., as an 'elegant writer' says, and so are some quotations. These have been identified with one exception. One anonymous reference (number 24 below) requires explanation because it is both anachronistic and interesting. Hume refers to an observation by "a late eminent philosopher". It is anachronistic because the book to which he refers was published after the Treatise; it is interesting because it provides further evidence of Hutcheson's influence on Hume and the latter' s regard for him. The explanation, for Hutcheson was still alive when Vol.11 of the Treatise appeared in 1739, is that 'late' is here being used in the sense of 'recent' - Hutcheson himself uses the word in the same way in referring to Mandeville when the latter was 54. alive. We present a one per cent measurement of the cosmic distance scale from the detections of the baryon acoustic oscillations in the clustering of galaxies from the Baryon Oscillation Spectroscopic Survey, which is part of the Sloan Digital Sky Survey III. Our results come from the Data Release 11 sample, containing nearly one million galaxies and covering approximately 8500 square degrees and the redshift range 0.2 < z < 0.7. We also compare these results with those from the publicly released (...) DR9 and DR10 samples. Assuming a concordance Λ cold dark matter cosmological model, the DR11 sample covers a volume of 13 Gpc3 and is the largest region of the Universe ever surveyed at this density. We measure the correlation function and power spectrum, including density-field reconstruction of the BAO feature. The acoustic features are detected at a significance of over 7σ in both the correlation function and power spectrum. Fitting for the position of the acoustic features measures the distance relative to the sound horizon at the drag epoch, rd, which has a value of rd,fid = 149.28 Mpc in our fiducial cosmology. We find DV = at z = 0.32 and DV = at z = 0.57. At 1.0 per cent, this latter measure is the most precise distance constraint ever obtained from a galaxy survey. Separating the clustering along and transverse to the line of sight yields measurements at z = 0.57 of DA = and H =. Our measurements of the distance scale are in good agreement with previous BAO measurements and with the predictions from cosmic microwave background data for a spatially flat CDM model with a cosmological constant. © 2014 The Author Published by Oxford University Press on behalf of the Royal Astronomical Society. In 2009, WW Norton published ‘The Red Book’, a book written by Jung in 1913-1914 but not previously published. Snippets of information about the likely contents of the Red Book had been in circulation for years, and there was much debate and eager anticipation of its publication within the Jungian field and the larger reading public. In 2010, a conference was held at the San Francisco Jungian Institute which brought together an international group of distinguished scholars in analytical psychology to (...) explore and address critical contextual aspects of ‘The Red Book’ and to debate its importance for current and future Jungian theory and practice. __The Red Book: Reflections on C.G. Jung’s _Liber Novus_ is based on that conference, the individual papers have been thoroughly revised and updated for this book and address some of the important questions and issues that were raised at that conference in response to the presentation of these papers. As yet there has been very little published about ‘The Red Book’. __The Red Book: Reflections on C.G. Jung’s _Liber Novus_ will contribute to setting the agenda for further research, both scholarly and clinical, in response to Jung’s account of his experiences between 1913-1914, when arguably, the future course of his entire project was set in motion. This book will be essential reading for any Jungian interested in the importance of The Red Book, analytical psychologists, trainee analysts, those with an interest in the history of ideas and historians. The fourteen authors in this collection used phenomenology and hermeneutics to conduct deep inquiry into perplexing and wondrous events in their work and personal lives. These seasoned scholar-practitioners gained remarkable insight into areas such as health care and illness, organ donation, intercultural communications, high-performance teams, artistic production, jazz improvisation, and the integration of Tai Chi into education. All authors were transformed by phenomenology's expanded ways of seeing and being.

Introduction: Probationers, offenders with less serious and non-violent offences, and under statutory supervision, have low levels of self-esteem and physical health, and high level of family conflict, and poorer quality of family relationships. This study examined the effectiveness of the existing probation service and the additional use of a positive family holistic health intervention to enhance physical, psychological, and family well-being in probationers and relationships with probation officers.Methods: Probationers under the care of the Hong Kong Social Welfare Department were randomized (...) into a care-as-usual control group, a brief intervention group receiving two 1-h individual sessions [of a brief theory-based positive family holistic health intervention integrating Zero-time Exercise and positive psychology themes of “Praise and Gratitude” in the existing probation service], or a combined intervention group receiving BI and a 1-day group activity with family members. The outcomes were physical activity, fitness performance, self-esteem, happiness, anxiety and depression symptoms, life satisfaction, quality of life, family communication and well-being, and relationships with probation officers. Self-administered questionnaires and simple fitness tests were used at baseline, 1-month and 3-month follow-up. Linear mixed model analysis was used to compare difference in the changes of outcome variables among groups, adjusted of sex, age, and baseline values. Focus group interviews were conducted. Thematic content analysis was used.Results: 318 probationers were randomized into CAU, BI, or CI group. CAU showed enhanced physical activity, fitness performance and psychological health, and family communication with small effect sizes. BI and CI showed further improved physical activity, family communication and family well-being. Additionally, CI reported greater improvements in the relationships with probation officers than CAU with a small effect size. CI also reported greater increases in physical activity and family communication than BI with small to moderate effect sizes. Qualitative feedbacks corroborated the quantitative findings.Conclusion: Our trial provided the first evidence of the effectiveness of probation service and the additional use of an innovative, relatively low-cost, theory-based brief positive family holistic health intervention. The essential logical deficiency of the perceptual theory of pain, as I tried to show in my paper,1 is that feeling pain cannot be perceiving anything. The conceptual framework that would make it possible for us to understand “feel” in this use to be a perception concept does not exist. The concept of a glimpse, which George Pitcher relies upon to supply this framework,2cannot begin to do so because it is a secondary perception concept entirely dependent upon that of (...) seeing. This primary concept of visual perception is tied up with actions and supporting concepts like looking, glancing, gazing, glimpsing, watching, and the like. These are different ways in which one's visual perceiving may be characterized. Without the primary concept and the actions connected with it, there would be nothing to characterize. The word “feel” in contexts involving pain is not a perception concept and efforts to make it one are doomed to fail. The supporting actions and concepts do not exist. (shrink)

There are two main formulations of a key causal principle in the Cartesian a priori philosophical system: one, present in Meditation III, says that the cause of the representational content of an idea must be situated at the same or higher level in ontology than the level at which the object represented is situated, the other, present in the axioms section of the Second Replies, says that the cause must contain the same property as is represented by the idea. This (...) central chapter defends four main contentions. The same‐property formulation is basic in Descartes's system. The notion of causality in the basic causal principle does not represent a spatio temporally extended natural process but a form of intentional explanation. When point is combined with the interpretation of the rule of truth offered in Ch. 2, the rule of truth and the basic causal principle prove to be equivalent. Finally, in light of, there is one main pattern of inference in Cartesian epistemology taking the rule of truth/causal principle as its major premise and underlying all of Descartes arguments from my ideas to the existence of things outside my ideas, including the proof of my own existence, the proof of the existence of God in Meditations III and V and the proof of the existence of the external world in Meditation VI and the Principles of Philosophy II,1. The leading idea of this chapter is that, for Descartes, intellectual ideas make it obvious what metaphysical category the properties they disclose to the mind fall into but not whether they are actually exemplified; sensations make it obvious whether the properties they disclose to the mind are exemplified but not what their metaphysical category is. This idea is worked out through a discussion of three stages in the development of Descartes's doctrine of the material falsity of sensory ideas, the core (...) concept of his error explanation of the senses. Material falsity is a set of three defects that sensations have in comparison with intellectual ideas, ideas that fully discharge the role, which Descartes assigns to ideas in his philosophical system. The first stage, reflected in Meditation III, identifies material falsity with two defects: nonrepresentation and misrepresentation ; the second stage, reflected in the Reply to Arnauld, identifies material falsity with obscure ideas ; the third stage, reflected in the Principles of Philosophy I, sees the terminology of material falsity disappear and the terminology of clear but not distinct ideas appear. The history of drug/vaccine development has included major advances guided primarily by risk/benefit analyses concerning the innovative agent, not by evidence-based clinical trials (Phase I–IV). Because the approval for new drugs is hindered under the present process, the system requires restructuring. The Phase I/II study period should be more flexible, using the “environment of knowledge” about the new agent, plus risk/benefit assessments. Phase III, as presently constructed, does not add new adverse events data, it provides a narrower profile of drug (...) efficacy than properly done Phase II studies, and placebo-controlled trials continue to raise unresolved ethical and social issues. Phase III studies should be abandoned for most drugs, and substituted with properly powered Phase II doseranging studies plus careful post-marketing surveillance. Phase III should be a penalty for poor drug development, not a regulatory requirement. (shrink)

In face of the multiple controversies surrounding the DSM process in general and the development of DSM-5 in particular, we have organized a discussion around what we consider six essential questions in further work on the DSM. The six questions involve: 1) the nature of a mental disorder; 2) the definition of mental disorder; 3) the issue of whether, in the current state of psychiatric science, DSM-5 should assume a cautious, conservative posture or an assertive, transformative posture; 4) the role (...) of pragmatic considerations in the construction of DSM-5; 5) the issue of utility of the DSM – whether DSM-III and IV have been designed more for clinicians or researchers, and how this conflict should be dealt with in the new manual; and 6) the possibility and advisability, given all the problems with DSM-III and IV, of designing a different diagnostic system. Part 1 of this article took up the first two questions. Part 2 took up the second two questions. Part 3 now deals with Questions 5 & 6. Question 5 confronts the issue of utility, whether the manual design of DSM-III and IV favors clinicians or researchers, and what that means for DSM-5. Our final question, Question 6, takes up a concluding issue, whether the acknowledged problems with the earlier DSMs warrants a significant overhaul of DSM-5 and future manuals. As in Parts 1 & 2 of this article, the general introduction, as well as the introductions and conclusions for the specific questions, are written by James Phillips, and the responses to commentaries are written by Allen Frances.
